General Terms and Conditions of Sale
1. GENERAL INFORMATION
These General Terms and Conditions of Sale (hereinafter referred to as the “General Conditions”) govern the sale of products via the website www.maliajewels.com, managed by the sole proprietorship Malia di Giulia Carboni, with registered office at Via Montezebio 5, 07100 Sassari (SS), Italy, VAT no. 03033150909, REA SS-224328.

2. ORDERS
2.1 Purchase Procedure
To place an order, the user selects the products and completes the purchase via the shopping cart. The order represents a contractual proposal. Confirmation of receipt does not constitute acceptance; the contract is concluded only upon dispatch confirmation.
2.2 Availability
Displaying a product on the Site does not imply that it is available for purchase. Malia reserves the right to update or change the assortment of products without prior notice. Malia is not liable for products that are out of stock or unavailable.
If, after order confirmation, the selected product is no longer available, Malia’s customer service will notify the Client via email or other agreed method. The Client may choose to replace the item or cancel the order.
If the order contains multiple items, Malia will indicate which are available and assist the Client in choosing between full or partial cancellation. Only the amount for available and confirmed products will be charged. If a replacement product is selected, a new order will be created.
3. PRICES AND PAYMENTS
All prices are listed in euros and include applicable taxes. Shipping costs are excluded. Malia reserves the right to change prices at any time without notice.
The applicable price is the one displayed at the time the Client submits the order via the “Place Order” button.
The Client is responsible for any communication costs (e.g., internet connection).
Payment must be made at the time of order. The amount will be reserved on the card and charged only upon order confirmation.
Payments are accepted via PayPal, and Visa or Mastercard credit/debit cards.
All orders must be placed in euros and include a delivery address.
Businesses and professionals who wish to receive an invoice must enter billing details at checkout.
Electronic invoices will be sent automatically via the SDI system.
4. SHIPPING
4.1 Orders are shipped via express courier to the address provided during checkout.
4.2 Estimated delivery times vary by destination and are shown during checkout. These times are indicative and not binding.
4.3 If the recipient is absent, the courier will attempt delivery a second time. If unsuccessful, the parcel will be held at the nearest depot.
Storage and re-delivery costs are the Client’s responsibility.
4.4 The risk of loss or damage passes to the Client upon delivery, unless the carrier was selected independently by the Client.
4.5 The Client may select a Fermopoint pickup location, if available at checkout. Notification will be sent by email when the package is ready.
4.6 The parcel remains available for 10 days at the pickup point. After that, it will be returned to sender.
4.7 In case of non-collection, any storage, return or re-shipping fees are at the Client’s expense.
4.8 Malia is only liable for loss or theft during shipment in cases of willful misconduct or gross negligence.
4.9 Any delivery issues must be reported within 7 days of receiving the package.
5. RIGHT OF WITHDRAWAL
In accordance with Legislative Decree 206/2005 (Consumer Code), the Client may withdraw within 14 days of receiving the products.
To exercise the right of withdrawal, send an email to contact@maliajewels.com within the deadline.
Products must be returned intact and in original packaging within 14 days of notification. Return shipping costs are borne by the Client.
Refunds will be made within 14 days of receiving the return.
The right of withdrawal does not apply to customized items.
6. LEGAL WARRANTY
Products are covered by a 2-year legal warranty against conformity defects, pursuant to Articles 128–135 of the Consumer Code.
This warranty does not cover:
– normal wear (e.g., oxidation of stainless steel, wear of 18K gold plating);
– misuse (exposure to damaging substances, detergents, heat, stress);
– negligent storage;
– unauthorized repair attempts.
In case of defects, contact contact@maliajewels.com for replacement or refund.
7. APPLICABLE LAW AND JURISDICTION
The contract is governed by Italian law.
Any dispute falls under the jurisdiction of the consumer’s place of residence.

8. INTELLECTUAL PROPERTY
All content on the Site (texts, images, logos, designs) is the property of Malia and unauthorized use is prohibited.

10. DELIVERY
Products are shipped to the address provided by the Client at the time of the order and confirmed in the order confirmation. Only one delivery address is allowed per order.
11. RETENTION OF TITLE AND TRANSFER OF RISK
Ownership of products remains with Malia until full payment is received.
Risk of loss or damage transfers to the Client upon delivery.
12. TERMINATION
Malia reserves the right to modify, suspend or terminate the website at any time.
Access may be restricted or suspended in case of violations of these Conditions or applicable laws, without notice.
Repeated violations of intellectual property rights may lead to permanent access termination.
13. WAIVER
Failure by Malia to enforce any right under these Conditions does not constitute a waiver.
If any clause is found invalid, the remaining provisions remain fully valid and enforceable.
14. BINDING AGREEMENT
The order confirmation and these General Conditions constitute the full agreement between the parties regarding the contract.
15. INTELLECTUAL PROPERTY AND TRADEMARKS
All trademarks, logos, texts, images, designs and content on the Site are exclusive property of Malia.
Reproduction, distribution or unauthorized use is prohibited.
Printing content is allowed only for personal use related to orders.
All other uses require written authorization.
16. COPYRIGHT AND VALIDITY
The Site’s content is protected by copyright. All rights reserved.
These Conditions remain valid until further publication.
17. WEBSITE TERMS OF USE
These Terms govern access and use of the website www.maliajewels.com.
Use of the site implies full acceptance of these Terms, applicable to all visitors and users.
Users are encouraged to read them carefully before browsing the site.
These Terms are effective from their publication and may be modified without notice.
17.1 ACCEPTANCE OF TERMS
Accessing, browsing, or using the site implies acceptance of these Terms, the General Conditions of Sale, and the Privacy Policy.
If the user does not agree, they must refrain from using the site.
17.2 MODIFICATIONS
Malia reserves the right to modify or replace these Terms at any time, without notice.
Continued use of the site implies acceptance of such changes.
17.3 DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, Malia is not liable for direct or indirect damages resulting from use of the website.
The site and its contents are provided “as is,” without warranties of any kind.
No guarantee is made that the site is error-free, virus-free, or uninterrupted.
The only remedy for dissatisfaction is to stop using the site.
17.4 INDEMNIFICATION
The user agrees to indemnify and hold harmless Malia and its representatives from any liability, damages, or costs arising from misuse of the site or violations of these Terms or applicable law.
Malia reserves the right to take over defense in disputes.
17.5 PROHIBITED CONTENT
Use of the site for illegal purposes, system intrusion, data scraping, spam, unauthorized access, reverse engineering, or third-party rights violations is prohibited.
17.6 VIRUSES, HACKING AND CRIMES
Introducing viruses, malware or cyberattacks against the site is prohibited.
Violations will be prosecuted by law.
17.7 TERMINATION
Malia reserves the right to suspend or terminate access for violations of these Terms or applicable law.
Provisions that survive termination remain valid.
17.8 WAIVER CLAUSE
Failure to enforce any right does not constitute waiver.
Invalidity of a clause does not affect the validity of others.

Reports will be reviewed and appropriate action will be taken.
18. FORCE MAJEURE
Malia is not liable for failure or delay in fulfilling contractual obligations due to events beyond its reasonable control (e.g., strikes, pandemics, fire, war, terrorism, blackouts, natural disasters, tech outages).
19. USER OBLIGATIONS
Users must provide accurate, complete, and updated information during checkout and must not use the site for illegal or fraudulent purposes.
20. ACCEPTANCE OF CONDITIONS
By placing an order, the Client confirms they have read, understood, and accepted the General Terms of Sale and Website Terms of Use.
Acceptance is a required condition to complete the order.
21. LIMITATION OF LIABILITY FOR SYSTEM ERRORS
Malia does not guarantee the Site is free of technical or content errors and reserves the right to correct such errors even after an order has been placed.
Use of the Site is at the user’s sole responsibility.
